1. Acceptance of Terms

By visiting https://www.2mattressmen.com, creating an account, or placing an order, you confirm that you have read, understood, and agreed to these Terms and Conditions in full. If you do not agree with any part of these terms, please do not use this website or place any orders.


We may update these Terms at any time. When we do, we will post the revised version on this page with an updated effective date. Your continued use of the website after any update means you accept the new terms.


2. Eligibility

To purchase from 2 Mattress Men, you must:

  • Be at least 18 years of age, or at least 13 years of age with verifiable parental or guardian consent
  • Be located in the United States
  • Provide accurate, complete, and current information when placing an order or creating an account


We do not sell to anyone under 13 years of age under any circumstances. If we become aware that a user under 13 has provided personal information or placed an order, we will cancel the order and delete the information immediately.


3. Products & Pricing

We sell inflatable mattresses, dog mattresses, car mattresses, and related comfort and bedding accessories. All prices are listed in US dollars (USD). Where required by applicable law, applicable taxes are displayed at checkout.


We reserve the right to change prices at any time. Price changes will not affect orders that have already been confirmed. Product images and descriptions are provided in good faith and are as accurate as possible. Minor variations in color, size, or appearance may occur due to manufacturing tolerances or screen display differences.


If a product is listed at an incorrect price due to a typographical error or system issue, we reserve the right to cancel the affected order and issue a full refund. We will notify you promptly if this occurs.


4. Order Process & Contract Formation

Submitting an order through our website is an offer to purchase, not a confirmed contract. A binding agreement between you and 2 Mattress Men is formed only when we send you an order confirmation email.


We reserve the right to decline or cancel any order for reasons including but not limited to:

  • Suspected fraudulent activity
  • Incorrect pricing due to a system error
  • Items that are out of stock or no longer available
  • Inability to verify payment or shipping information


If we cancel your order after payment has been collected, a full refund will be issued within 7 business days. All contracts are formed and conducted in English.


5. Payment Terms

Full payment is required at the time of purchase. We accept the following payment methods:

  • Visa
  • Mastercard
  • American Express
  • Discover
  • JCB
  • Apple Pay
  • Google Pay


All transactions are processed securely through Shopify Payments or authorized third-party payment processors. We do not store full payment card details on our servers. We are not responsible for errors, failures, or delays caused by third-party payment processors.


If you initiate a chargeback without first attempting to resolve the matter with us, we reserve the right to flag your account and dispute the chargeback with supporting documentation. We encourage all customers to contact us directly before involving their bank or card issuer.


6. Shipping & Delivery

We ship to all 50 US states. We do not currently ship to US territories, APO/FPO addresses, or international destinations unless explicitly stated at checkout.


Estimated delivery timeframes:

  • Order processing: 1 to 3 business days after payment is confirmed
  • Transit time: 3 to 5 business days depending on your location
  • Total estimated delivery: 4 to 8 business days from order confirmation


These timeframes are estimates only. We are not responsible for carrier delays, weather-related disruptions, incorrect addresses provided by the customer, or packages confirmed as delivered by the carrier but claimed as missing. Once an order is handed off to the carrier, risk of loss transfers to you as the customer, in accordance with UCC Section 2-509.


If your package appears lost or was delivered to the wrong address due to an error on your part, please contact us and we will do our best to assist, though we cannot guarantee a replacement or refund in those circumstances.


7. Returns, Refunds & Exchanges

You may return eligible items within 30 days of the delivery date. To be eligible, items must be unused, unassembled, and returned in their original packaging with all included accessories.


The following items are not eligible for return:

  • Items returned after the 30-day window
  • Items that have been used, inflated for extended periods, or show visible signs of wear
  • Items damaged due to misuse, improper storage, or customer error
  • Items missing original packaging, parts, or accessories
  • Clearance or final sale items marked as such at the time of purchase


Refunds are issued to the original payment method within 7 business days of us receiving and inspecting the returned item. Return shipping costs are the customer's responsibility unless the return is due to our error or a product defect. No restocking fee is charged.

8. Title & Risk of Loss

Title to any product purchased from our store passes to you upon full payment and physical delivery of the item. Until full payment is received and confirmed, 2 Mattress Men retains title to all goods.


Risk of accidental loss, damage, or delay passes to you at the point the package is handed to the carrier for delivery. This is consistent with UCC Section 2-509. We are not responsible for damage or loss that occurs after the carrier takes possession of the shipment.


9. Intellectual Property

All content published on https://www.2mattressmen.com, including but not limited to text, product images, graphics, logos, and site design, is the property of 2 Mattress Men or its licensors and is protected under US copyright and trademark law.


You may not copy, reproduce, distribute, modify, display, or use any content from this website for commercial purposes without our prior written consent. Unauthorized use may result in legal action.


If you submit any content to us, such as product reviews or photos, you grant 2 Mattress Men a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content in connection with our products and marketing.


10. Prohibited Uses

You agree to use this website only for lawful purposes and in a manner consistent with these Terms. The following activities are strictly prohibited:

  • Using the site for any fraudulent, deceptive, or unlawful purpose
  • Attempting to gain unauthorized access to any part of the website or its systems
  • Using automated tools, bots, or scrapers to extract data from the site
  • Submitting false orders or providing inaccurate account information
  • Harassing, threatening, or impersonating any person in connection with the site


Violation of these restrictions may result in order cancellation, account suspension, and potential legal action.


11. Disclaimer of Warranties

Products sold by 2 Mattress Men are provided as described on our product pages. We make no additional express warranties beyond what is stated in the product listing. To the fullest extent permitted by applicable law, we disclaim all implied warranties, including implied warranties of merchantability and fitness for a particular purpose.


Some US states do not permit the disclaimer of implied warranties. If you are a resident of such a state, this disclaimer may not apply to you in full, and you may retain additional rights under your state law.


12. Limitation of Liability

To the maximum extent permitted by applicable law, 2 Mattress Men's total liability for any claim arising from a purchase made on this website is limited to the amount you paid for the specific order giving rise to that claim.


We are not liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profit, loss of data, or loss of use, even if we were advised of the possibility of such damages.


These limitations do not apply to claims arising from fraud, gross negligence, personal injury caused by a defective product, or any other situation where applicable state or federal law prohibits such a limitation. Nothing in these Terms limits any rights you have under your state's consumer protection laws.


13. Product Liability

2 Mattress Men sells products in compliance with applicable US product safety standards. You agree to use all products in accordance with the instructions provided and any warnings displayed on or with the product.


We are not liable for injury, damage, or loss resulting from misuse, modification, or improper assembly of any product purchased from our store. If you believe a product has a safety defect, please contact us immediately at support@2mattressmen.com.


14. Privacy & Data (Reference Only)

Your use of this website is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy explains how we collect, use, and protect your personal information in compliance with the California Consumer Privacy Act (CCPA/CPRA), COPPA, CAN-SPAM, and other applicable US privacy laws.

15. US State-Specific Consumer Rights

These Terms are intended to work alongside your rights under applicable federal and state consumer protection laws, not to limit or override them. Customers in California, New York, Texas, Florida, and all other US states retain all rights afforded to them under their respective state statutes.


If any provision in these Terms conflicts with your state's consumer protection laws, the applicable state law will prevail with respect to your rights as a consumer. You are never required to waive any statutory right as a condition of purchasing from us.


16. COPPA — Children's Privacy

This website is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If we discover that a child under 13 has submitted personal information through our website or placed an order, we will delete that information and cancel the order immediately.


If you are a parent or guardian and believe your child under 13 has provided us with personal information, please contact us at support@2mattressmen.com and we will take prompt action to remove that data.


17. CAN-SPAM — Email Marketing

If you opt in to receive marketing emails from 2 Mattress Men, we will only send you emails that are relevant to your interests and purchases. Every marketing email we send includes a clear and working unsubscribe link.


We honor all opt-out requests within 10 business days of receipt. We do not use deceptive subject lines, false sender information, or misleading headers in any email communication. Transactional emails related to your order, such as order confirmations and shipping updates, are not subject to opt-out and will be sent regardless of your marketing preferences.


18. Dispute Resolution & Arbitration

Binding Arbitration: If a dispute cannot be resolved informally, both parties agree that it will be resolved through binding arbitration under the American Arbitration Association (AAA) Consumer Arbitration Rules, rather than in court. Arbitration is conducted on an individual basis.


Class Action Waiver: By agreeing to arbitration, you waive your right to participate in a class action lawsuit or class-wide arbitration against 2 Mattress Men.


Small Claims Exception: Either party may bring a qualifying claim in small claims court instead of arbitration, provided the claim falls within that court's jurisdictional limits.


How to Opt Out: You may opt out of the arbitration agreement by emailing support@2mattressmen.com within 30 days of your first purchase. Your opt-out must include your full name, order number, and a clear statement that you are opting out of arbitration.


19. Governing Law & Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law principles.


For any disputes not subject to arbitration, both parties consent to the exclusive jurisdiction of the state and federal courts located in Luzerne County, Pennsylvania. However, nothing in this section limits any rights you may have under the consumer protection laws of your own state of residence.


20. Changes to These Terms

We may revise these Terms at any time without prior notice. When we do, the updated version will be posted on this page with a new effective date. It is your responsibility to review these Terms periodically. Your continued use of the website after any changes are posted constitutes your acceptance of the revised Terms.


21. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, or severed from these Terms if modification is not possible. All remaining provisions will continue in full force and effect.


22. Entire Agreement

These Terms and Conditions, together with our Privacy Policy, Return & Refund Policy, and any other policies published on this website, constitute the entire agreement between you and 2 Mattress Men with respect to your use of this website and any purchases made through it. These Terms supersede any prior agreements, understandings, or representations, whether written or oral, relating to the same subject matter.
